The Epiphany Glow Program (“Program”) is a rewards program offered by Epiphany Dermatology to eligible Epiphany Dermatology patients and customers located in the United States. Membership in the Program is limited to individuals only and is limited to one account per individual. You must be:

• At least 18 years old, and;
• Must have legal capacity to enter into a binding legal agreement.

BY APPLYING FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE YOU HAVE AGE AND LEGAL ELIGIBILITY TO BE BOUND BY THESE TERMS AND CONDITIONS (“TERMS”). NO PURCHASE IS NECESSARY TO JOIN THE PROGRAM.

Program rewards accrued by Program participants in calendar year 2025 will be available for redemption on eligible cosmetic products and services beginning on January 1, 2026, in-person at Epiphany Dermatology locations. Services that are reimbursable by insurance (even if of a cosmetic nature), medical services offered by Epiphany Dermatology and surgical procedures (including cosmetic surgical procedures) are not eligible for rewards. Local office participation and services may vary based on provider and inventory availability.

Program rewards are only for your personal benefit and use through your personal Program account and cannot be sold, advertised for sale, bartered, transferred or used by anyone else.

TO THE FULLEST EXTENT PERMITTED BY LAW, EPIPHANY DERMATOLOGY WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON EPIPHANY DERMATOLOGY’S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND EPIPHANY DERMATOLOGY AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.

EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ITS RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER PARTY IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.

IF ANY DISPUTE OR CONTROVERSY CANNOT BE SETTLED BY THE PARTIES THROUGH DISCUSSION ALONE, THE DISPUTE OR CONTROVERSY WILL BE SETTLED EXCLUSIVELY BY BINDING ARBITRATION IN AUSTIN, TEXAS, BY A SINGLE ARBITRATOR PURSUANT TO THE AMERICAN ARBITRATION ASSOCIATION’S COMMERCIAL ARBITRATION RULES, INCLUDING THE OPTIONAL RULES FOR EMERGENCY MEASURES OF PROTECTION, THEN IN EFFECT.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without reference to conflicts of law rules. You further expressly consent and agree to submit to the exclusive jurisdiction and venue located in Austin, Texas.

The provisions of this Program are intended to be interpreted in a manner that makes them valid, legal and enforceable. If any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal and enforceable. It is expressly understood and agreed by the parties that such modification or restriction may be accomplished unilaterally by Epiphany Dermatology or, alternatively, by an arbitrator. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from these Program Terms without affecting the validity, legality or enforceability of any of the remaining provisions.
